Terms of Service

These Terms of Service govern the use of vigilomedtech.com (“Vigilo” or the “Site”) and the purchase of services from Vigilo. They include both website usage rules and commercial terms.

1. Our services

Vigilo brings together career opportunities and industry information for regulatory affairs, quality and clinical professionals across Europe.

Candidates can browse jobs, create a private profile, save opportunities and request personalised job alerts. Candidate services are free.

Business customers can purchase job publications, subscriptions, featured placements, newsletter advertising, dedicated emails, LinkedIn promotion and employer-brand content, as offered at the time of purchase.

Vigilo provides advertising, information and job-discovery services. We do not make hiring decisions, employ candidates on behalf of advertisers or charge placement commissions.

2. Scope and acceptance

You must accept these Terms when registering an account, submitting content or purchasing services where acceptance is requested.

Paid services are offered exclusively to customers acting for business or professional purposes. Anyone ordering on behalf of an organisation must have authority to bind that organisation.

Your contract consists of these Terms, the product description presented when ordering and any specific terms expressly agreed in writing.

If there is a conflict, an individually negotiated agreement takes precedence, followed by the specific accepted order, followed by these Terms. A customer’s purchasing conditions apply only if we expressly accept them.

Our Privacy Policy and Cookie Policy explain our handling of personal data and tracking technologies. Acceptance of these Terms does not constitute consent to promotional emails or optional tracking.

3. Accounts and eligibility

Account registration and newsletter subscriptions are intended for people aged 18 or over.

You must provide accurate information and keep relevant account details up to date. Keep your login credentials confidential and notify us promptly if you suspect unauthorised access.

You must not impersonate another person or claim a company page without authority. We may request reasonable evidence before granting or maintaining access to an employer account or company page.

You are responsible for your own account activity and access you authorise.

4. Acceptable use

You must not:

  • Submit false, fraudulent, discriminatory or otherwise unlawful information.
  • Advertise vacancies or use company materials without appropriate authority.
  • Use listings to obtain fraudulent payments or unnecessary personal information from candidates.
  • Send spam, phishing messages, malicious links or malware.
  • Harass, threaten or impersonate others.
  • Infringe intellectual property, privacy or confidentiality rights.
  • Access private information or systems without authorisation.
  • Circumvent security controls or account restrictions.
  • Use automated tools in ways that misuse personal data or materially disrupt the Site.
  • Reproduce or commercially redistribute substantial parts of the Site without permission or another lawful basis.

Search-engine indexing of public pages is permitted subject to our published technical instructions. This permission does not extend to private accounts or restricted information.

5. Candidate profiles and applications

Candidate profiles are private. Under the current service, they are not publicly searchable, accessible to recruiters or available for employers to download.

Authorised personnel and service providers may access profile information where necessary to operate and support Vigilo, as described in our Privacy Policy.

Vigilo does not offer CV uploads or collect application dossiers through candidate profiles.

Applications take place through the employer’s or recruitment provider’s application channel linked from each listing. The receiving organisation is responsible for its recruitment process and its handling of application information.

Vigilo does not receive or forward your application dossier through that external process.

Recommendations and alerts help you discover opportunities based on relevant information and preferences. They do not constitute an assessment of your eligibility or guarantee an interview, response or employment.

6. Listings and advertiser responsibilities

An advertiser must have authority to publish the vacancy and use the company name, logo, text and other materials it supplies.

Listings must describe genuine opportunities accurately and comply with applicable employment, advertising, non-discrimination and data protection requirements.

Advertisers must maintain a working application destination and promptly update or remove vacancies that are filled, withdrawn or materially changed.

Recruitment agencies must be authorised to advertise the opportunities they submit.

We may review content before publication and request corrections, clarification or evidence of authority. Review does not certify the advertiser or transfer its responsibilities to Vigilo.

We may refuse content that is unlawful, misleading, outside our professional scope or inconsistent with these Terms.

7. Aggregated opportunities

Some listings are sourced from external career pages or job-data providers rather than submitted directly by employers.

A company’s name, logo or vacancy appearing on Vigilo does not, by itself, establish a commercial relationship, partnership or endorsement.

Vacancies may change or close before updates reach the Site. Candidates should consult the original listing for current information.

Company names, trademarks and third-party materials remain subject to their owners’ rights.

To report an expired, inaccurate, fraudulent or potentially infringing listing, email contact@vigilomedtech.com with the page address and relevant details.

8. Orders and contract formation

Before placing an order, customers must review the service, price, currency, applicable taxes, duration and any recurring commitment.

For online orders, the contract is formed when the customer completes the payment-required checkout and payment is successfully confirmed. We send an electronic order confirmation.

For orders agreed directly, the contract is formed when both parties expressly accept the written proposal or order, including these Terms. A quotation alone does not create a contract.

Publication remains subject to content review. If we reject an order before delivering any service and cannot agree a compliant alternative, we refund any payment received for that order.

We will not substitute a materially different service or increase an accepted price without your agreement.

9. Prices, taxes and payment

The price and currency presented and accepted when ordering apply to the purchase.

Applicable taxes and any additional charges imposed by Vigilo are identified before the order is placed. Your bank or payment provider may separately charge currency-conversion or transfer fees.

Online purchases are payable at checkout through the available payment methods.

Where we agree to invoice, payment is due within 30 calendar days of the invoice date unless the accepted order specifies otherwise. Publication may begin before payment where invoice terms have been agreed.

Customers must provide accurate billing information and promptly notify us of any genuine invoice dispute.

For overdue, undisputed amounts, we may send a payment reminder and give an additional seven calendar days to pay before suspending affected paid services. Suspension does not remove amounts already due.

We will not continue charging indefinitely for services we have permanently stopped providing. Any termination and remaining payment obligations are subject to the contract and applicable law.

10. Publication and delivery

A standalone job listing runs for the period stated in the accepted order. Where the order specifies 30 days, the period starts when the listing is first published.

Subscription access starts on the activation date confirmed with the order. Where no later start date is agreed, activation follows successful payment and account provisioning.

Customers must supply the materials and approvals needed to deliver the service. If these are missing, we will explain what is required and agree an appropriate schedule.

Newsletter, email and LinkedIn placements are scheduled with the customer. Purchasing a service does not reserve a specific publication date unless that date is expressly confirmed.

If a material delay is attributable to Vigilo, we will propose a revised schedule. If we cannot deliver within a reasonable additional period, the customer may cancel the undelivered part and receive the corresponding refund.

11. Featured Job Listings

Unless the accepted order expressly provides otherwise, a Featured Job Listing includes:

  • 30 days of featured placement on Vigilo.
  • The company logo, job description and a direct application link.
  • One mention in a weekly newsletter edition.
  • One guaranteed inclusion in a collective LinkedIn post featuring up to five jobs.
  • Reporting on listing views, application-link clicks, newsletter delivery totals and LinkedIn post reach, where applicable.

A second collective LinkedIn inclusion may be provided at Vigilo’s discretion. It is not guaranteed and does not create a refund entitlement if omitted.

Featured placement does not guarantee a fixed position above every other featured listing.

A standalone Featured Job Listing covers one vacancy. Replacing it with a materially different vacancy requires a new purchase or our express agreement.

A dedicated LinkedIn post is a separate service and is not included in the collective LinkedIn placement.

12. Starter subscription

Starter provides up to three active standard job listings at a time.

While the subscription is active, you may update listings and replace closed vacancies within those three slots. These are reusable simultaneous slots, not three new publication credits each month.

Each listing includes the company logo, a job description and a direct application link. Starter also includes reporting on listing views and application-link clicks, and email support.

Featured placement, newsletter mentions and LinkedIn promotion are not included unless separately purchased.

Starter is billed monthly and renews automatically for successive monthly periods. There is no annual commitment.

You may cancel renewal at any time before the next renewal date. Cancellation takes effect at the end of the current paid monthly period.

Unused slots do not accumulate, carry forward or create a refund entitlement.

13. Standard subscription

Standard provides up to five active standard job listings at a time, together with a branded company page, onboarding support, listing-view and application-click reporting, and a quarterly performance summary.

You may update listings and replace closed vacancies within those five slots while the subscription remains active.

Featured placement, newsletter mentions and LinkedIn promotion are not included unless separately purchased.

Standard has a 12-month minimum commitment, billed in monthly instalments. Monthly billing does not make it a month-to-month subscription.

At the end of the initial term, Standard renews automatically for a further 12 months unless renewal is cancelled before the renewal date. The same rule applies to subsequent annual terms.

We will send a renewal reminder at least 30 days before the annual renewal date. If we fail to do so, you may cancel the renewed term within 30 days after receiving notice of renewal, paying only for services used during that renewed term.

Cancellation during an annual term prevents the next renewal but does not release the remaining monthly instalments for the current committed term, except where termination is justified by our breach or mandatory law.

Unused slots do not accumulate or create a refund entitlement.

14. Subscription administration

Each subscription covers one legal entity. It may not be shared across a corporate group or resold without written agreement.

A recruitment agency may advertise authorised client vacancies through its own subscription, but may not transfer its account or subscription access to clients.

To cancel renewal, use the account cancellation function where available or email contact@vigilomedtech.com from an authorised business contact. Email cancellation is valid even if no account cancellation function is available.

We will confirm the cancellation and effective end date. A cancellation received before renewal remains effective even if our acknowledgement follows later.

Deleting an account, removing advertisements or stopping use of the Site does not, by itself, cancel a subscription.

When a subscription ends, included paid publication rights and enhancements end. Publicly sourced company information or independently aggregated vacancies may remain on the Site; they are not a continuation of the paid service.

Any separately purchased service retains its own agreed duration.

Subscription price increases apply only to future renewal periods. We will notify customers at least 30 days in advance and allow them to cancel renewal before the increase takes effect. If that notice cannot be provided in time, the increase is deferred.

15. Other promotional services

Newsletter sponsorships, dedicated emails, dedicated LinkedIn posts, employer-brand content and report sponsorships include only the deliverables expressly listed in the accepted order.

One dedicated LinkedIn placement means one non-collective post featuring the agreed vacancy or employer-brand content.

Newsletter sponsor exclusivity means one sponsoring brand in the booked edition. It does not prevent that edition from containing ordinary vacancies, editorial references or links concerning other companies, including competitors.

No industry-wide or competitor exclusivity applies unless expressly agreed in writing.

Dedicated sponsored emails are limited to one per advertiser per calendar month and four in total per calendar month across all advertisers. Dates remain subject to availability and confirmation.

Sponsors do not receive candidate profiles or subscriber lists.

Content requiring customer approval will not be published before that approval. Once an email has been sent or a social post published, it cannot necessarily be recalled or removed from third-party copies.

16. Results and reporting

We undertake to deliver the purchased publication or promotional service, not a particular recruitment outcome.

Unless expressly agreed in writing, we do not guarantee minimum views, clicks, applications, interviews, hires or revenue.

No clicks or applications does not, by itself, establish a failure to deliver the service.

Reports use the measurements available from the relevant systems. Consent choices, privacy settings, automated traffic, filtering and third-party reporting limitations may affect the figures.

An application-link click is not proof of a completed application or hire. Reach and audience figures from different channels may overlap and do not necessarily represent unique individuals.

17. Cancellation, refunds and service issues

Business purchases do not include a voluntary cooling-off period.

Unless otherwise agreed, a change of mind, an early hire, withdrawal of a vacancy or the customer’s decision not to use a purchased service does not create a refund entitlement.

You may request early removal of a listing. Removal does not create a refund for its remaining publication period. Subscription slots remain reusable within the applicable plan limits.

These rules do not excuse Vigilo from delivering the agreed service.

If a service is materially defective or incomplete, notify us at contact@vigilomedtech.com. We will investigate and, where appropriate, correct the problem, restore the missing publication period or provide an agreed replacement.

If we cannot remedy a material failure within a reasonable period, you may terminate the affected undelivered service and receive a proportionate refund.

We will not substitute a credit for a refund without your agreement.

Mandatory legal remedies remain unaffected.

18. Intellectual property and submitted content

Vigilo’s original branding and editorial materials belong to Thomas Cardot or are used under licence. Platform technology and third-party materials remain the property of their respective owners.

You retain ownership of materials you submit.

For public content, you grant us a non-exclusive, royalty-free licence to host, format, reproduce and display it to provide the requested service. Where promotion is purchased or authorised, this includes the agreed distribution channels.

Minor formatting and typographical corrections are permitted. Material changes to meaning require your approval.

For private profile information, processing is limited to providing the relevant account features and services as described in our Privacy Policy. This clause does not permit public promotional use or recruiter access.

Licences continue only as needed to deliver the service and maintain lawful records and residual backups. Previously distributed emails and third-party copies may remain accessible after a campaign ends.

19. Editorial content and third-party services

Vigilo’s articles, newsletters, summaries and translations provide general information. They do not replace legal, regulatory, clinical or other professional advice tailored to a specific situation.

Check original sources and seek qualified advice before making consequential decisions.

External career sites, payment services and social platforms operate under their own applicable terms and privacy information. We do not control their independent decisions or availability.

This does not remove our responsibilities for services we sell or providers acting on our behalf.

20. Moderation and account restrictions

We may restrict content or access where reasonably necessary to investigate fraud, address security risks, comply with the law or respond to a material breach of these Terms.

Where practicable, we will explain the issue and allow a reasonable opportunity to correct it. Immediate action may be necessary where delay would create a risk.

You may request review of a decision by emailing contact@vigilomedtech.com.

Where a customer materially breaches these Terms and fails to remedy the breach after reasonable notice, we may terminate the affected service. Any sums retained for undelivered services must be justified by applicable law and actual contractual entitlement; termination does not automatically entitle us to keep every prepaid amount.

If we discontinue a paid service for reasons unrelated to the customer’s breach, we will refund the unused prepaid portion and cancel charges for the undelivered remainder.

21. Availability and events beyond reasonable control

We take reasonable steps to maintain the Site but cannot guarantee uninterrupted or error-free operation.

Maintenance, outages and events beyond reasonable control may affect delivery. We will take reasonable steps to limit disruption and communicate material effects on purchased services.

For a material interruption to paid visibility, we will restore the missing period or agree an appropriate remedy. If continued performance becomes impracticable, either party may end the affected undelivered service, with a proportionate refund of prepaid fees.

22. Liability

Each party remains responsible for its obligations under the contract and applicable law.

We do not guarantee the conduct of independent employers or candidates, or the outcome of a job search or advertising campaign.

To the extent permitted by law, we exclude liability for indirect or consequential losses caused by ordinary negligence, including loss of anticipated profits or business opportunities.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury where liability cannot be excluded, or any other liability that cannot lawfully be restricted.

Mandatory data protection and consumer rights remain unaffected. Liability provisions do not remove an express obligation to refund an undelivered service.

23. Changes to these Terms

We may update these Terms to reflect changes in our services or legal requirements.

The version accepted when ordering governs that order and its current committed term unless a change is required by law or expressly agreed.

Material changes proposed for a subscription renewal will be communicated at least 30 days before renewal, with an opportunity to cancel renewal. We will obtain fresh acceptance where required.

Changes affecting free account services will be communicated appropriately. We will request renewed acceptance where necessary.

24. Governing law and disputes

These Terms are governed by Swiss law.

This choice does not deprive individuals of mandatory protections applicable under the law of their habitual residence where those protections cannot be excluded.

For business customers acting in a professional capacity, the competent courts at the operator’s domicile in Ticino, Switzerland, have exclusive jurisdiction to the extent legally permitted.

For other users, jurisdiction is determined by applicable law.

You may contact us to seek an informal resolution, but this is not a condition for exercising legal rights or contacting a competent authority.
